Please read these Terms of Service carefully before using our platform. By registering, posting a listing, or making a payment, you agree to be bound by these terms. If you do not agree, do not use the platform.

  1. About the platform

Jahfast Company Limited is an online marketplace that allows businesses and individuals (“Advertisers”) to publish promotional listings and advertisements for a fee, and allows other users (“Seekers”) to browse, discover, and request promotional services.

These Terms govern your access to and use of our website, mobile application, and all related services (collectively, the “Platform”).

  1. Eligibility
  • You must be at least 18 years old to use this Platform.
  • By using the Platform, you confirm that you have the legal capacity to enter into a binding contract.
  • Businesses must be duly registered in their jurisdiction of operation.
  • We reserve the right to refuse service to anyone at our sole discretion.
  1. Account registration

To access paid features, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain and promptly update your account details.
  • Keep your login credentials confidential and secure.
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account.
  1. Advertising and listings

Advertisers may submit listings to promote their business, product, or service, subject to the following:

  • All listings must be truthful, accurate, and not misleading.
  • You must have full rights to all content you submit, including images, logos, and text.
  • Listings must comply with all applicable laws, including advertising standards and consumer protection regulations in your jurisdiction.
  • We reserve the right to approve, reject, edit, or remove any listing at any time without prior notice.
  • Listings must not promote illegal goods or services, hate speech, explicit content, or anything we deem harmful or inappropriate.
  • You are solely responsible for the accuracy and legality of your listing content.
  1. Promotional services and seekers

Users who seek promotional opportunities through the Platform (“Seekers”) acknowledge that:

  • Listings and promotions are provided by third-party Advertisers. We do not verify, endorse, or guarantee any claims made by Advertisers.
  • Any agreement, transaction, or engagement entered into between Seekers and Advertisers is solely between those parties.
  • We are not liable for any loss, damage, or dissatisfaction arising from such engagements.
  • We do not act as a party to any contract between Seekers and Advertisers.
  1. Fees and payments
  • Access to advertising features requires payment of applicable fees as displayed on the Platform at the time of purchase.
  • All fees are quoted in [currency] and are inclusive/exclusive of applicable taxes (state clearly).
  • Payments are processed through our third-party payment processor. We do not store full payment card details.
  • Fees are non-refundable unless expressly stated in our Refund Policy or required by law.
  • We reserve the right to change our fee structure at any time. Updated pricing takes effect upon renewal or your next purchase.
  • Failure to pay may result in suspension or termination of your listing or account.
  1. Prohibited conduct

You agree not to:

  • Use the Platform for any unlawful or fraudulent purpose.
  • Post false, deceptive, or spam content.
  • Impersonate any person, business, or entity.
  • Scrape, harvest, or collect data from the Platform without our written consent.
  • Attempt to gain unauthorized access to any part of the Platform or its systems.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Use the Platform to send unsolicited commercial communications (spam).
  • Post content that infringes any intellectual property rights of any third party.

Violation of these prohibitions may result in immediate account suspension or termination, and may be reported to relevant authorities.

  1. Intellectual property

All content on the Platform — including but not limited to design, layout, graphics, logos, and software — is our property or licensed to us, and is protected by applicable intellectual property laws.

By submitting content (e.g., listing copy, images, logos), you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content solely for the purpose of operating and promoting the Platform.

You retain ownership of your submitted content. You represent and warrant that you own or have all rights necessary to grant us this license.

  1. Disclaimer of warranties

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not endorse or guarantee the quality, accuracy, or reliability of any Advertiser listing.

  1. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Platform.

Our total cumulative liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the greater of (a) the total fees paid by you in the twelve (12) months preceding the claim, or  ₦10,000.

  1. Indemnification

You agree to indemnify, defend, and hold harmless Jahfast Company, its directors, officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Platform. You are not allowed to sue for any claim.
  • Your listing content or promotional materials.
  • Your breach of these Terms.
  • Any violation of applicable law by you.
  1. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms.

You may terminate your account at any time by contacting us. Termination does not entitle you to a refund of unused fees unless required by law.

Upon termination, all licenses granted to you under these Terms shall immediately cease. Sections that by their nature should survive termination shall do so.

  1. Governing law and dispute resolution

These Terms shall be governed by and construed in accordance with the laws of Federal Republic of Nigeria.

Any dispute arising from these Terms or your use of the Platform shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Delta State Nigeria. in accordance with the rules of Nigerian Constitution.

Notwithstanding the above, either party may seek urgent injunctive relief from a competent court.

  1. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform or sending an email to your registered address. Continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.

  • Device and technical data:IP address, browser type and version, operating system, device identifiers, and referring URLs.

  • Directly from you when you register, create a listing, make a payment, or contact us.

We use your personal data for the following purposes:

  • To create and manage your account.
  • To process payments and issue receipts.
  • To publish and manage your advertising listings.
  • To match Seekers with relevant promotional opportunities.
  • To communicate with you about your account, transactions, and Platform updates.
  • To send you marketing communications (only where you have consented or we have a legitimate interest, and always with an opt-out option).
  • To improve, personalise, and secure the Platform.
  • To comply with legal obligations and enforce our Terms of Service.
  • To detect, prevent, and investigate fraud, abuse, or other harmful activity.
  1. Legal basis for processing

We process your data based on the following legal grounds:

  • Contract:Processing necessary to fulfil our agreement with you (e.g. delivering your listing).
  • Legitimate interests:Improving the Platform, preventing fraud, and direct marketing to existing customers.
  • Legal obligation:Compliance with applicable laws and regulations.
  • Consent:Where we ask for and you give explicit permission (e.g. marketing emails to new contacts).
  1. Sharing your data

We do not sell your personal data. We may share it with:

  • Service providers:Payment processors, cloud hosting providers, email delivery services, and analytics platforms — bound by data processing agreements.
  • Other users:Information you include in your public listing (business name, description, contact details) is visible to all Platform users.

We retain your personal data for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce our agreements.

When data is no longer needed, we securely delete or anonymise it.

  • Refund: There is room for immediate refund without the use of our services if no service is used or rendered in 1 hour of payment.

If we transfer your personal data outside your country of residence, we ensure adequate protections are in place — such as standard contractual clauses or transfers to countries with recognised adequacy decisions — in accordance with applicable data protection laws.

Our Platform is not directed to individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that a minor has provided us with data, we will delete it promptly. If you believe a minor has submitted data to us, contact us at privacy@jahfast.com.
